Acknowledgments
The most commonly performed Notary act is the Acknowledgement. Its primary purpose is to positively identify the document signer and confirm that they are the person named in the document. By obtaining an acknowledgement, it ensures that the signer is not an imposter attempting to benefit from a fraudulent document. During an acknowledgement, the Notary meticulously verifies the identity of the document signer, who then acknowledges their signature. This acknowledgement is crucial for the acceptance of a document by a county recorder. For instance, real estate deeds and other documents related to property ownership must have their signatures acknowledged before they can be considered authentic and recorded in the public record.
Jurats
The purpose of a Notary act known as a Jurat is to ensure the honesty of a document signer. It is also referred to as a verification upon oath or affirmation. During this process, the Notary appeals to the signer's conscience and begins a procedure that could lead to criminal charges for perjury if the signer is found to be lying under oath. To execute a jurat, the Notary must witness the signer physically sign the document. The signer then makes a solemn, oral promise of truthfulness to a Supreme Being (referred to as an Oath) or a promise on their personal honor (referred to as an Affirmation). Both the oath and affirmation have the same legal effect. Jurats are commonly used for documents that may be presented as evidence in court proceedings, such as depositions and affidavits.
Certified Copies
The purpose of the Notary act called Copy Certification is to verify that a photocopy of a document is a complete and accurate reproduction of the original. During this process, the Notary carefully compares the copy to the original to ensure they are identical. However, it's important to note that many states have restrictions on copy certifications or do not allow Notaries to perform them. In Texas, for example, Notaries can only certify copies of documents that cannot be recorded with any government entity. Additionally, certain documents, such as USCIS documents, vital records like birth, death, and marriage certificates, and recordable documents like deeds, should not be copy-certified by a Notary.
Protests
A Protest is a written statement by a Notary or authorized officer indicating that payment for a negotiable instrument, such as a check or promissory note, has not been received. When payment is not made on a negotiable instrument, it is considered dishonored. Notary acts of protest can be complex and diverse. Therefore, only a Notary with the necessary expertise or one working under the guidance of an experienced bank officer or attorney should perform a protest.
Depositions
A Deposition is a legal document that records a person's spoken statements, which can be used in a lawsuit. To create a deposition, a court reporter typically records the deponent's answers to a series of questions posed by attorneys. Once the transcript is typed, the deponent signs it before a witness. A Notary is likely to be involved in a deposition in one of two ways: either by swearing in the deponent, recording the testimony, and witnessing the deponent's signature; or solely by administering an oath to the deponent and executing a jurat if the court reporter is from out of state and cannot serve in a notarial capacity. In the latter case, no unique abilities are required.
